THE LAW


Immigration and Refugee Protection Act (IRPA), Section 91:
No person shall knowingly, directly, or indirectly, represent or advise on immigration matters for a fee unless they are:
(a) a lawyer who is a member in good standing of a law society of a province or a notary who is a member in good standing of the Chambre des notaires du Québec;
(b) any other member in good standing of a law society of a province or the Chambre des notaires du Québec, including a paralegal; or
(c) a member in good standing of the designated regulatory body (ICCRC).


Citizenship Act, Section 21.1:
Every person commits an offence who knowingly, directly or indirectly, represents or advises a for consideration — or offers to do so — in connection with a proceeding or application under this Act.

Subsection (1) does not apply to:
(a) a lawyer who is a member in good standing of a law society of a province or a notary who is a member in good standing of the Chambre des notaires du Québec;
(b) any other member in good standing of a law society of a province; or
(c) a member in good standing of a body designated under subsection (5).

Duke Sherwood is in constant contact with some leading Canadian legal luminaries and, having subscribed to the Federal Court of Canada for updates on current Immigration litigation affecting applicants around the world, adds comfort to those candidates seeking a trusted, experienced and knowledgeable counsel to represent them in their applications to either enter Canada on a Temporary basis or as Permanent Residents.
